About these terms

These terms are an agreement between you and Nolan Media, 6240 Main Street, Suite 3, Cass City, Michigan 48726, United States. They apply when you use this website, when you create or use a Nolan Media account, when you use a Nolan Media application, and when Nolan Media does client work for you.

By using any of these, you agree to these terms. If you do not agree, do not use them.

Services

Nolan Media provides a range of services and products including website design, Google Business Profile setup and maintenance, web application development, publishing, and other digital and creative work. The specific scope of any service engagement is agreed upon before work begins.

Nolan Media accounts

Some Nolan Media applications require an account. One Nolan Media account signs you in to all of them, including Voidmail Pro, Divinio, MorphManager, and Little Roadside Stand.

• You must be at least 13 years old to create an account.
• The information you give when creating an account must be accurate, and you should keep it current.
• Your account is yours. Do not share your password, and do not let someone else use your account.
• You are responsible for activity under your account. If you believe it has been used without your permission, tell us at support@nolanmedia.cc promptly.
• You can delete your account at any time — see the Data Deletion page.

Nolan Media may suspend or close an account that is used to break these terms, to break the law, or to harm other users or the service. Where it is reasonable to do so, you will be told why and given a chance to put it right first.

Signing in with Google or Facebook

You may sign in using a Google or Facebook account instead of setting a password. If you do, you are also bound by that provider's own terms, and what they collect is governed by their privacy policy. What Nolan Media receives is set out in the Privacy Policy.

Google and Meta are not sponsors of, and are not involved in, Nolan Media applications. If you lose access to the Google or Facebook account you signed in with, contact us and we will help you regain access to your Nolan Media account.

Acceptable use

When using Nolan Media applications, do not:

• Break the law, or use the service to help someone else break it
• Attempt to access another person's account or data
• Probe, scan, overload, or interfere with the service or the systems it runs on
• Copy, resell, or redistribute the service without written permission
• Upload malware, or content you have no right to upload
• Harass, threaten, or impersonate other people
• Scrape or harvest data from the service by automated means, unless we have agreed to it

Your content

Clients and users retain ownership of their own business content, text, photos, and branding, and of anything they upload to a Nolan Media application. By uploading it, you give Nolan Media the limited permission needed to store, process, and display it in order to run the service for you — nothing beyond that. Nolan Media retains the right to reference completed client work in a portfolio unless specifically asked not to.

You are responsible for having the rights to the content you upload. Content that breaks these terms may be removed.

No guarantee of results

Nolan Media does not guarantee search rankings, website traffic, customer calls, leads, or sales. Services are intended to improve basic online presence, accuracy, and professionalism. Search rankings are determined by Google and other search engines, not by Nolan Media.

Payment

Payment terms are agreed upon before work begins. Work does not start until a deposit or full payment is received, as agreed. Refunds are handled on a case-by-case basis before delivery of completed work.

Monthly care plan

The monthly care plan includes hosting, basic monitoring, backup and version history, and one batch of small edits per month. It does not include full redesigns, new multi-page sections, custom software features, ecommerce functionality, paid advertising, or daily changes. Either party may cancel with reasonable notice.

Availability and changes to the service

Nolan Media applications are provided on a best-effort basis and may be unavailable for maintenance, upgrades, or reasons outside our control. Features may be added, changed, or removed. If an application is to be discontinued, you will be given reasonable notice and an opportunity to retrieve your data.

Provided as is

Except where a separate written agreement says otherwise, Nolan Media applications and this website are provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the fullest extent permitted by law, Nolan Media is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data arising from your use of the website or the applications. Nolan Media's total liability for any claim relating to a free application is limited to one hundred United States dollars; for paid services, it is limited to the amount you paid in the twelve months before the claim arose.

Some jurisdictions do not allow these limits, in which case they apply to the extent permitted there.

Ending the agreement

You may stop using the services and delete your account at any time. Nolan Media may end this agreement with you if you break these terms. The sections on your content, provided as is, limitation of liability, and governing law survive the end of the agreement.

Governing law

These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law rules. Disputes will be brought in the state or federal courts located in Michigan, unless the law where you live gives you the right to bring them elsewhere.

Changes to these terms

These terms may be updated from time to time. The date at the top of the page shows when they last changed. Material changes affecting account holders will be notified by email or by a notice in the application before taking effect. Continued use after that constitutes acceptance.
